Regulatory Bodies

ADU regulations in Palo Alto are governed by both the State Code and local laws. The state oversees certain ADU types, including:

  • A newly constructed detached ADU on a lot with an existing or proposed single-family dwelling (up to 800 sq. ft., 16 ft height, 4 ft setbacks).
  • Conversion of non-livable areas in multi-family dwellings.

Zoning Requirements

ADUs are permitted on properties zoned for:

  • R-1 (single-family residences)
  • R-2, R-E, R-M, RMD (multi-family and residential estates)

Unit Numbers and Size

  • Single-family homes: One ADU and one JADU are allowed.
  • Multi-family homes: Up to two detached ADUs are allowed.
  • Minimum Size: 150 sq. ft.
  • Maximum Size:
    • Detached ADUs: 800 sq. ft. (State Code), 900-1,000 sq. ft. (local regulation, depending on bedrooms).
    • Attached ADUs: Maximum of 50% of the size of the primary dwelling.
    • JADUs: 500 sq. ft.

Building Height

  • Detached ADUs (State Code): Maximum 16 ft.
  • Attached ADUs: Height matches the main dwelling, with zoning requirements.
  • Local regulations may allow taller ADUs (up to 30 ft in specific zones).

Setbacks

  • Detached ADUs: 4 ft from side/rear lot lines.
  • Attached ADUs: Typically 6 ft from side/rear lot lines.
  • Eaves can extend 2 ft into setbacks.

Parking

  • Replacement parking is not required if converting a parking space into an ADU.
  • New parking spaces must meet size requirements (10 ft x 18 ft).
  • ADUs on corner lots cannot have entrances facing the same lot line as the main dwelling unless in the rear half of the lot.

Fire Safety

  • Fire sprinklers are only required for ADUs if they are required for the primary residence. However, compliance with the California Fire Code is required.
