What is an Accessory Dwelling Unit (ADU)?

An ADU is an independent residential unit on the same lot as a primary home, providing additional living space, rental opportunities, or multi-generational housing. A prefab ADU is a permanent, factory-built backyard home that meets local zoning and building codes, making it ideal for long-term living.

Tiny homes, often confused with prefab ADUs, are small, mobile units built on wheels. While both can be ADUs, prefab ADUs are stationary and built to last, whereas tiny homes face more zoning challenges due to their mobility.

Types of ADUs

  • Detached: A newly constructed unit that is separate from the primary structure.
  • Attached: A newly constructed unit that is attached to the primary structure.
  • Junior Accessory Dwelling Unit (JADU): A conversion of existing space, up to 500 square feet, contained entirely within a single-family residence.

Zoning and Lot Size

  • ADUs & JADUs: Allowed in residential and mixed-use zones.
  • ADUs (Section 17.44.060(B)): Permitted in zones for single-family or multifamily housing, including:
    • Rural Residential (RR)
    • Single Family (SF)
    • Multifamily (MF)
    • Multifamily Beach Front (MFBF)
    • Planned Development (PD)
  • Fire Safety Requirement: Malibu is in a Very High Fire Hazard Severity Zone, so streets must be at least 20 feet wide for ADU approval.
  • Multifamily Lots: ADUs are allowed, but new attached ADUs are not permitted.

Size and Floor Area

  • Attached ADU
    • 0-1 Bedroom: Up to 850 sq. ft.
    • 2 Bedrooms: Up to 1,000 sq. ft.
    • Cannot exceed 50% of the primary residence.
  • Detached ADU
    • 0-1 Bedroom: Up to 850 sq. ft.
    • 2 Bedrooms: Up to 1,000 sq. ft.
  • Junior ADU (JADU)
    • Maximum 500 sq. ft.

Setbacks and Height

Attached ADU

  • Setbacks: 4 feet (side/rear).
  • Height: 16 feet.

Detached ADU

  • Setbacks:
    • 4 feet (side/rear).
    • 6 feet from the primary residence.
    • Front setback: 20% of lot depth or 65 feet, whichever is less.
  • Height: 16 feet.

Junior ADU (JADU)

  • Setbacks: 4 feet (side/rear).

Parking Requirements

    • One off-street parking space required per ADU (can be enclosed or unenclosed).
    • Unenclosed parking allowed in setbacks or as tandem parking.
  • Parking Exceptions (No parking required if):
    • Within ½ mile of public transit.
    • Located in a historic district.
    • Part of the primary residence or an accessory structure.
    • On-street permits are required but not available to ADU occupants.
    • A car-share stop is within one block.
    • The ADU is part of a new single-family or multifamily home application.
  • No Replacement Parking Required
    • If a garage, carport, or covered structure is demolished or converted into an ADU, replacement parking is not required.
    • If the owner chooses to provide replacement parking, it must be on hardscape.
