What is an ADU (Accessory Dwelling Unit)?

An ADU is an independent residential unit on the same lot as a primary home, providing additional living space, rental opportunities, or multi-generational housing. A prefab ADU is a permanent, factory-built backyard home that meets local zoning and building codes, making it ideal for long-term living.

Tiny homes, often confused with prefab ADUs, are small, mobile units built on wheels. While both can be considered ADUs, prefab ADUs are stationary and built to last, whereas tiny homes face more zoning challenges due to their mobility.

Types of ADUs:

  • Detached: A new construction built separately from the primary structure.
  • Attached: A new construction attached to the primary structure.
  • Conversion: The conversion of an existing space within a primary residence or a detached accessory structure.
  • Junior Accessory Dwelling Unit (JADU): The conversion of existing space, up to 500 square feet, entirely within a single-family residence.

Zoning and Lot Size

ADUs and JADUs are permitted in all Residential zoning districts and Planned Development zoning districts that allow residential development, including A, R-1, R-2, R-M, and PD. ADUs are also permitted in the C-1 zoning district.

For a single-family residence, a maximum of one ADU and one JADU are allowed per property. However, no ADU or JADU is permitted on a lot created through an Urban Lot Split in accordance with DMC Chapters 8.81 and 9.54 if the lot was previously vacant. A JADU may be added in addition to a detached ADU.

For a multi-family residence, a maximum of two detached ADUs are allowed per property. Additionally, within multi-family zoning districts, the total number of ADUs converted from non-livable space within an existing structure may not exceed 25% of the legally established dwelling units.

Size and Floor Area

  • Attached ADU:

    • Maximum area: 1,200 sq. ft.

    • Shall not cover more than 60% of the lot.

    • Shall not exceed 50% of the primary residence’s floor area.

  • Detached ADU:

    • Maximum area: 1,200 sq. ft.

    • Shall not cover more than 60% of the lot.

  • JADU (Junior ADU):

    • 150–500 sq. ft.

Setbacks and Height

  • Attached ADU:
    • Setbacks: 4-foot side/rear setbacks.
    • Height: 16 feet.
  • Detached ADU:
    • Setbacks: 4-foot side/rear setbacks; 10 feet from the primary residence; 20-foot front setback.
    • Height: 16 feet.
  • Conversion of Existing Area:
    • Setbacks: No setback is required for the conversion of an existing living area or accessory structure, or for a structure built in the same location and with the same dimensions as an existing structure that is converted to an ADU.
  • JADU (Junior ADU):
    • Setbacks: 4-foot side/rear setbacks.

Parking Requirements

  • ADUs need one off-street parking space per unit or per bedroom (whichever is less), except for studio ADUs, which don’t require parking. Parking can be covered or uncovered and must follow DMC Chapter 8.76.
  • JADUs don’t require parking, but if provided, the space must meet DMC Chapter 8.76 rules and can be compact, uncovered, or in tandem with the primary residence’s parking.
  • No parking is required for an ADU if any of the following apply:
    • It’s within ½ mile of a public transit stop.
    • It’s part of a historic structure.
    • It’s inside an existing or planned residence/accessory structure.
    • On-street parking permits are required but not available for ADU residents.
    • A car-share vehicle is within one block.
